Back injuries can vary depending on the severity of the accident and the part of the back affected. Benefits for those who will miss two or more weeks of work will include compensation based on the average weekly wage from the previous year. Medical coverage will pay for all care to treat the injury. For example, a spine injury may require physical therapy and medical equipment. Workers' compensation will also pay for these necessities. Additional compensation time can happen if the injury causes permanent disability.

How Workers' Compensation Defines Spine Injuries

Spine injuries affecting the neck and back have become a common problem for many workers. The injury types can involve broken bones or nerve damage along the spine. Many also experience sprains, strains, and herniated discs. Causes frequently include slips and falls, impacts, and repeated movements.

Who Qualifies for Benefits?

Employees with spinal injuries from an at-work accident can receive workers' compensation benefits. Aside from easily diagnosed injuries like a broken bone after a fall, many back injuries will need extensive medical assessment to determine if they happened at work.

Why is Having a Disability Lawyer Important?

Back pain can arise from prior injury, aging, or genetics. These concerns make it difficult for many employees to receive the testing and treatment needed for worker's compensation benefits. Claim denials can happen if the employee has a medical history of back pain or related prior conditions.

Our spine injury lawyers can help clients build their cases and prove their injury was work-related. Our law firm can assist with a variety of issues regarding previous injuries. They can review the work performed at the time of injury and if the employer had provided safety equipment and proper training to protect workers.

How Much are the Benefits?

Back injuries can vary depending on the severity of the accident and the part of the back affected. Benefits for those who will miss more than one week of work will include weekly compensation payments based on a percentage of the average weekly wage from the previous year. Medical coverage will pay for care to treat the injury. For example, a spine injury may require physical therapy and medical equipment. Workers' compensation will also pay for these necessities. Frequently insurance companies will deny treatment. It is important to have an experienced workers' compensation lawyer to work with your doctors to help obtain authorization for all suggested medical treatments. Additional compensation time can happen if the injury causes permanent disability.

There is no set amount for a Section 32 Settlement. A Section 32 Settlement is negotiated between the injured worker and the insurance company. There is a wide array of variables involved in a settlement that prevents a reliable estimate. The amount of the section 32 settlement will vary based on the earnings of the injured worker, how long the injured worker has received the compensation, and how long they will be expected to receive wages in the future. Among many other factors, the medical care needed for the injury or illness, the lost income amount, and much more can affect what amount the insurance company agrees to offer in a settlement. It is important to have a lawyer experienced in all aspects of the workers' compensation claims to receive the best settlement.

Ouimette, Goldstein, & Andrews Back Injury Disability Client Testimonial

"The settlement for my back injury was not enough to pay for the ongoing medical care I would need, and the insurer wouldn't negotiate. I worried my benefits would run out before I could find a solution. Finally, my lawyer took over the case, and I received a reasonable settlement offer in weeks."

Case Study On The Frequency and Reasons People Injured On The Job Don't File Claims

An OSHA study revealed the inadequacies of employee care when employers fail to keep them safe. Complaints about workplace injuries often focus on the cost to the employer. The statistics show a different story. Employers who do not provide adequate training and safety equipment do not feel the brunt of the fallout from injuries. The most impacted are the workers and their families through lost income opportunities and overwhelming medical debt. Insurance companies and taxpayers pay most of the remaining costs.

Multiple causes exist for the problem. The most common is the unwillingness of employees to file compensation claims and the lack of training to prevent accidents. Immigrant and low-wage employees were less likely to report a work-related accident because they feared losing their job. Less than 40 percent of these eligible workers applied for compensation benefits. A California study showed that one-third of injured workers had not filed a claim even after severe accidents involving amputations.

The other concern was an untrained workforce. The increasing use of temporary services produced a revolving door effect of people rarely on a worksite long enough for adequate training. Another issue with training occurred on worksites with workers from multiple companies. Few employers joined together on these sites to provide consistent safety training for all.

Workers injured on the job because of the lack of training must file compensation claims. No one should fear the loss of employment for accessing legally provided benefits. A lawyer can help anyone in this situation get the medical care they need.
