What is a Head Injury?

Falls, vehicle accidents, blows to the head, and many other incidents cause head injuries. As a result, people may experience concussions, skull fractures, hematomas, and more. All forms of traumatic brain injury (TBI) can cause lifelong health concerns.

Determining the type of injury someone receives in an accident without extensive medical testing is impossible. Any impact to the head, especially if it causes a loss of awareness for a few minutes, requires a medical examination.


Who Qualifies for Benefits?


A head injury caused by a workplace accident will qualify the individual for workers' compensation. Minor bumps and mild concussions may only require a day off and emergency medical care to determine the severity. Workers' compensation will cover the medical costs. More severe incidents that result in the loss of 14 days or more of work will also qualify the worker to receive wage replacement compensation.


Employees qualify for workers' compensation whenever an accident occurs while working. A claim disqualification is possible if the employee is intoxicated, willingly involved in a workplace fight, or misbehaving in some manner. Employees do not need to be on company property at the time of the accident to file a claim, but they must have been performing a work-related task.

How Much are the Benefits?

Workers' compensation for lost time due to a head injury, or any other injury, entitles the injured employee to receive payments for lost wages as long as the lost wage exceeds seven days. The injured employee is considered disabled and entitled to claim lost wage benefits if the injury causes them to be unable to perform all or part of their work.  If the claimant has a permanent disability with a permanent loss of wage-earning capacity, the injured worker would be entitled to claimed benefits for a period of time into the future. Even if the injured worker has returned to work, they may be entitled to weekly compensation benefits if the injured worker is forced to earn less money due to their head injury.
