What is a Loss of Vision Injury?

Eye injuries can cause reduced vision or complete blindness. It may affect the eye or the ocular nerves. Workplace accidents that cause this can include chemical spills, fire, steam burns, or head traumas. Debris in the eye could also result in a loss of vision. Infectious eye diseases can also cause vision loss. Transmission at work of these diseases can happen if bodily fluids meet the eye's mucous membrane.

Who Qualifies for Benefits?

Employees receive workers' compensation for vision loss for incidents that happen at the workplace. People with vision loss from a traumatic event need immediate emergency care services to protect their sight. Medical assessments and emergency care for infections caused by transmittable diseases should happen as soon as the worker notices the problem. Notify employers immediately of the accident so they can file a claim with the Workers' Compensation Board.

Why is Having a Lawyer Important?

Our loss of vision lawyer often helps clients receive benefits after a denial or assists them with receiving a disability diagnosis from their physician. Many incidents involve trauma and cause undeniable damage to the head or eye. Claim denials are less likely in these instances, but the claim may not cover the extent of the damage. Claim denials may happen more often with infections caused in the workplace because the worker must prove the problem began there. A lawyer can oversee the process to ensure their client has all the information needed to prove their claim.

How Much are the Benefits?

Workers' with a partial or total disability from vision loss may be entitled to lost time awards. Additionally, if the loss of vision is permanent, the injured worker may be entitled to a permanent schedule loss of use award for the loss of vision. Depending on the percentage of the loss of use, the injured worker can receive an award for up to 160 weeks of benefits. The wage compensation and the amount of the loss of use award can vary depending on the percentage loss of vision that is found by the physician.

If the injured worker has a permanent schedule loss of use, they are entitled to benefits for a certain number of weeks, depending on the affected body part, less previously paid benefits. An injured worker does not have to have lost time in order to have an entitlement to a permanent schedule loss of use payment

Ouimette, Goldstein, & Andrews Permanent Loss of Vision Client Testimonial

"Flying debris at work caused me to lose sight in my right eye. The pain and emotional trauma made it difficult to return immediately to work. I thought I would be homeless when workers' compensation denied my claim. My lawyer prevented that by getting my claim approved and helping me negotiate a better settlement a few months later."

Employer Safety for Loss of Vision Injuries - A Case Study

The American Optometric Association (AOA) provides detailed guidelines for better eye safety in the workplace. Every day, about 2,000 American workers require medical treatment for work injuries involving the eye.

Safety precautions and proper training can prevent many of these accidents. In addition, immediate and effective first aid responses at the workplace can reduce the severity. Their report states that safety precautions could prevent or lessen the damage in 90 percent of vision-related accidents.

Another concern mentioned in the AOA article is the lack of workplace safety. Three out of five workers with eye injuries were not wearing eye protection. Most of the injured people were unaware of the danger to them at their job before their accident. Better employer oversight could reduce these injuries, protect employees, and lower insurance costs.

OSHA recommendations require eye and face protection in many workplaces for this purpose. Workers injured because they were not trained in safety practices or provided with adequate gear deserve workers' compensation benefits when an unexpected trauma causes vision loss.
