Slips and falls cause workers to lose nearly 24,000 workdays yearly in the United States. Employers experience financial losses of over 17 million annually because of the incidents. As a result, some employers will attempt to avoid submitting workers' compensation claims to avoid the potential costs associated with a slip and fall.

What are Slip and Fall Injuries?

Anyone falling from a height, tripping over unseen items or uneven pavement, or slipping because of a wet surface can suffer from injuries requiring medical attention. The types of falls possible at a workplace are endless, and all are covered when they happen while performing work-related duties. Despite seeming like a minor incident, 37 percent of fatalities in the workplace are due to slips and falls. The results can include broken bones, traumatic brain injury, and more.

Who Qualifies for Benefits?

The law requires almost all employers in New York State to cover their employees with compensation insurance. As a result, anyone employed by these companies can file a claim for benefits under the workers' compensation system if a slip and fall cause them to lose work time and experience injuries that need medical attention.

Why is Having a Lawyer Important?

It is not unusual for people to lose their balance and fall. Most people experience this type of accident at some point. The commonness of the event can cause employers to distrust reports that the injuries happened at work. It is possible the worker may experience a denial if they have previously experienced accidents at home or have hobbies that are known for resulting in bodily injuries. The employer may even believe the individual fell because of an underlying health condition. Not every fall happens in front of witnesses, so proving the injury is genuine and work-related could be difficult without the help of a slips and falls lawyer.

Slips and falls cause workers to lose nearly 24,000 workdays yearly in the United States. Employers experience financial losses of over 17 million annually because of the incidents. An accident can raise the rates an employer pays for their workers' compensation insurance and may make them vulnerable to OSHA inspections. Some employers will attempt to avoid submitting workers' compensation claims to avoid the potential costs associated with a slip and fall.

How Much are the Benefits?

Workers' compensation benefits for slips and falls begin when the employee cannot work for at least seven days because of the injury. The program also covers any emergency coverage for the accident, even if the employee returns immediately to the worksite.

Compensation benefits include two-thirds of the average weekly wage up to the statutory maximum for weekly benefits. If an injured worker can return to work with limitations due to their injury, they may be entitled to an award for reduced earnings, even though they are working. Many injured workers do not realize they are entitled to an award for reduced earnings when they are working with limitations due to the work-related injury. Thus it is important to keep copies of pay stubs and consult with your workers' compensation lawyer.

Ouimette, Goldstein, & Andrews Client Testimonial

"I received a settlement offer after a fall at work. The money seemed like a lot to me, but my friends told me to talk to a lawyer. The lawyer I met with at Ouimette, Goldstein & Andrews, showed me how the money would run out long before my medical appointments stopped. I had no idea I would have to pay for them if that happened. The team at the law firm saved me from making a huge mistake."

Case Study Workers' Compensation Slips and Falls Injury Law Firm Ouimette, Goldstein, & Andrews

Slip and Fall Case Study. Why You Should Consider Hiring a Workers' Compensation Law Firm

At a 2019 hearing before the Workers' Compensation Board, a claimant received coverage approval for home health care services after a slip-and-fall accident. Despite previously receiving compensation for permanently disabling injuries, the employer wanted to reduce the amount of coverage awarded. The employer insisted the fall happened because of the employee's multiple sclerosis and was not work-related.

Evidence presented during the hearing proved the man's underlying health condition was not the cause of the fall. The decision allowed the claimant to receive reimbursement for home health aide services paid by him for over two years.

The case also included the declaration that the worker is permanently completely disabled and entitled to coverage of all home health aide services on an ongoing basis, 24 hours a day, seven days a week.
